Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in connection with Barhi P. S. Case No. 72 of 2020 pending in the Court of learned Judicial Magistrate, 1^st Class, Hazaribag.

It has been submitted by the learned counsel for the petitioner that the petitioner is in custody since 14.02.2020. Although he has been named in the FIR that he has killed the deceased by pressing neck, but this fact has not been supported by post-mortem report.

On the other hand, learned APP has opposed the prayer for bail

Perused the record. It appears that vide order dated 17.10.2020, viscera forensic report of the deceased from the State Forensic Science Laboratory, Ranchi has been called for. A report has been received vide Letter No. 5452 dated 17.12.2020, which is kept on record. As per the report, no such material has been received for forensic test by the laboratory till date. It further appears that allegation of pressing neck, as alleged by the informant, does not get support from the medical evidence.

Considering the material available on record, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Hazaribag in connection with Barhi P. S. Case No. 72 of 2020 subject to the condition that the petitioner will submit self attested copy of his Aadhar Card and also give his mobile number before the learned court below which he will not change during pendency of this case without prior permission of the court.
