The matter was taken up through Video Conferencing. Learned counsel for the parties had no objections with it and submitted that the audio and video qualities are good.

03/11.01.2021 : The present application has been filed for grant of regular bail to the petitioner in connection with Special (N.D.P.S.) Case No.11 of 2019 arising out of Nirsa P.S. Case No.179 of 2019, registered for the offence under Sections 20(b)(ii)(c) of the N.D.P.S. Act.

Learned counsel for the petitioner has submitted that the applicant is in judicial custody since 06.06.2020. It has been stated that earlier the case has been lodged after recovery of Ganja against one coaccused namely Chiranjit Ghosh and three unknown persons. The police has submitted a final form against Chiranjit Ghosh and subsequently, the case has been transferred to the CID. After investigation the CID has found that this applicant along with three other persons namely Rajiv Rai, Ravi Kumar Thakur and Sunil Kumar Choudhary have placed the narcotics material in the jeep to falsely implicate Chiranjit Ghosh. Sunil Choudhary @ Pasi @ Sunil Kumar Choudhary @ Sunil Pasi and Ravi Kumar Thakur @ Ravi Thakur have been granted bail by a co-ordinate bench of this Court vide order dated dated 14.09.2020 passed in B.A. No. 5741 of 2020 and B.A. No.5131 of 2020. On this ground prayer for bail has been made.

Counsel for the State has opposed the prayer for bail and submitted that this applicant was only an instrument in obtaining the narcotic materials which have been recovered from the possession of Chiranjit Ghosh.

Considering the material available on record and the fact that the similarly situated co-accused persons have already been granted bail,

the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, Dhanbad, in connection with Special (N.D.P.S.) Case No.11 of 2019 arising out of Nirsa P.S. Case No.179 of 2019, subject to condition that the petitioner will submit self-attested photocopy of his Aadhar Card and also submit his mobile number before the learned court below which he will always keep active and not change it during pendency of this case without prior permission of the court.
