The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities are good.

03/04.01.2021 The petitioner is accused in connection with Borio P. S. Case No. 247 of 2019 corresponding to G.R. No.374 of 2019 (S.T. Case No.317 of 2019), registered under Section 302 of IPC.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 15.06.2019 and there is no material against the petitioner save and except the suspicion that he was in relationship with the deceased and out of that relationship a son has been born and still the petitioner was not accepting the deceased as his wife. Further they have seen in village fair and thereafter the dead body of the deceased has been recovered.

Learned A.P.P. has opposed the prayer for bail and submitted that the mother of the deceased has clearly stated against the petitioner that due to the previous relationship, her daughter has been killed by this petitioner.

Considering the material available on record and period of custody, the petitioner, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Sahibganj in connection with Borio P. S. Case No. 247 of 2019 corresponding to G.R. No.374 of 2019 (S.T. Case No.317 of 2019) subject to the condition that petitioner will submit self attested copy of his Aadhar Card and also give his mobile number before the learned court below which he will not change during the pendency of this case without prior permission of the court.
