2. The learned counsel for the petitioner submits that the petitioner, who is the original resident of Village-Motia, Thana-Gangta Govindpur, P.S. No. 305, District-Godda, is now settled in USA and has status of Non-Resident Indian (NRI). His land pertaining to Khata No. 30, Daag No. 207, 205, 204 measuring an area of 0.264 acre situated at Village-Motia, Thana-Gangta Govindpur, P.S. No. 305, District-Godda has been acquired for construction of Thermal Power Project under the land acquisition proceeding being L.A. Case No. 47 of 2016-17. Though the petitioner is the lawful claimant to receive the compensation in lieu of acquisition of the said land, the respondent no. 3 – the District Land Acquisition Officer-cum-Deputy Collector Land Reforms, Godda referred the case along with one Rakesh Jha to the Principal District & Sessions Judge-cum-Land Acquisition, Rehabilitation & Resettlement Authority, Dumka, vide letter no. 753 dated 13.07.2018 which has been registered as L.A. Case No. 42 of 2018. The grievance of the petitioner is that though he being an NRI, physically appeared before the said authority in the aforesaid land
