Heard the learned counsel appearing for the respective parties.
The petitioner is an accused in connection with Barwadda P.S. Case No. 79 of 2021.
It has been alleged that Sanjay Kumar Mahto and Md. Suleman Ansari on the pretext of selling a land had taken a huge amount of money from the husband of the informant. It has further been alleged that the documents handed over on verification were found to be inconsistent with respect to the land in question. On repeated request some amount was returned, but a major chunk was retained by the accused persons.
It has been submitted by the learned counsel for the petitioner that Suleman Ansari is the owner of the land who had purchased it from Chudhu Mahto @ Chudha Mahto. It has further been stated that the land was mutated in favour of Suleman Ansari and correction slip was issued consequent to which Suleman Ansari is paying rent to the State. It has further been submitted that the said Md. Suleman Ansari has been granted anticipatory bail by this Court in A.B.A. No. 6258 of 2021.
Mr. Pratyush Lala, learned counsel for the informant has opposed the prayer for bail of the petitioner and has submitted that the petitioner is also involved in divesting the husband of the informant of a huge amount.
On consideration of the fact co-accused Md. Suleman Ansari has been granted anticipatory bail by this Court as noted above and Sanjay Kumar Mahto @ Sanjay Mahto who happens to be the brother of the petitioner having been granted bail by this Court in B.A. 12855 of 2021, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Dhanbad in connection with Barwadda P.S. Case No. 79 of 2021.
