Heard Mr. Amar Kumar Sinha, learned counsel appearing on behalf of the petitioners and Mr. Rajesh Kumar Singh, learned A.C. to G.P.-VI appearing for the respondent-State of Jharkhand.
The petitioners have preferred this writ petition for a direction upon the respondents particularly the respondent no.5 to pass the order for determination of rent of the lands measuring 24.06 acres comprised within Plot Nos.353, 579, 613, 1321, 1349, 1350, 598, 346, 247, 312, 318, 645, and 646 of Khata No.01, 02, 04 and 109 situated at village Banari, P.S. Bishunpur, District Gumla.
Mr. Amar Kumar Sinha, learned counsel appearing for the petitioners submits that the Misc. Case No.7 of 1997-98 is pending since long and no order has been passed as yet by the respondent no.5 for determination of rent, for which, this writ petition has been filed.
Mr. Rajesh Kumar Singh, learned A.C. to G.P.-VI appearing for the respondent-State submits that at paragraph 14 of the counter affidavit it is stated that after issuance of notice dated 13.08.2016 the Miscellaneous Case No.7 of 1997-98 filed by the petitioners is now on board for hearing and the petitioner may appear in the matter and the same may finally be decided.
Upon which, Mr. Amar Kumar Sinha, learned counsel for the petitioners fairly submits that in view of the statement made in paragraph 14 to the counter affidavit, the petitioner is ready to appear and co-operate before the authority concerned so that the matter may be decided at an early date.
In view of the above facts and submissions, the writ petition is disposed of by directing the petitioner to appear before the authority concerned, the authority concerned will decide the matter in accordance with law after providing an opportunity of hearing to the petitioners.
Accordingly, the writ petition stands disposed of.
