Heard Mr. Pravin Kumar Rana, the learned counsel appearing for the petitioner, Mrs. Richa Sanchita, the learned counsel appearing for the respondent-Jharkhand Academic Council (JAC) and Mr. Shubham Mishra, the learned AC to SC-II appearing for the respondent-State.

The petitioner has preferred this writ petition for quashing the order dated 30.01.2015 whereby the representation of the petitioner for grant of permission for establishment of proposed school has been rejected on the ground that the petitioner is not fulfilling the criteria for such permission as the building and security money are not in

accordance with the said criteria for granting permission.

The learned counsel appearing for the petitioner submits that now the school in question has fulfilled their criteria and a fresh representation has been filed on 05.05.2015 indicating that all the criteria have been fulfilled. He submits that the security money has also been deposited.

At this stage, the learned counsel appearing on behalf of the respondent-JAC submits that if it is so, the respondent-JAC will consider and pass appropriate order in the interest of justice.

In view of the above facts and the submissions, the petitioner is directed to file a fresh representation before the respondent No.5 along with all the supporting documents within a period of three weeks. If such a representation is filed within the aforesaid period, the Secretary, Jharkhand Academic Council will take a decision on the said representation within eight weeks thereafter. The decision taken by the respondent no.5 shall be communicated to the petitioner within one week thereafter.

With the aforesaid observation and direction the instant writ petition being W.P.(C) No.601 of 2015 stands disposed of.
