1. Heard Mr. Akash Bhushan, learned counsel appearing on behalf of the Appellant.
2. This petition has been filed for the following reliefs: - “That the petitioner had approached this Hon’ble court vide Arb. Application. No. 8/2013 for appointment of an Arbitrator in the dispute of the present petitioner and respondent.”
3. The learned counsel for the appellant submits that although the present case has been mentioned to be an arbitration appeal, but in fact the present petition is a petition for appointment of an Arbitrator. He further submits that the present petition is still defective and he wants to withdraw this petition with a liberty to proceed as per law.
4. Considering the submissions made, this petition is hereby dismisses as withdrawn with a liberty to the appellant to proceed as per law.
