1. Heard Mr. Navnit Prakash, counsel appearing on behalf of the petitioner along with Mr. Shashi Bhushan Gupta, Advocate.

2. Heard Mr. Akchansh Kishore, learned counsel appearing on behalf of the respondent.

3. By order dated 13.12.2019, this Court had proposed to appoint Mr. Rahul Gupta, learned Advocate of Jharkhand High Court, as learned Arbitrator to adjudicate the dispute between the parties for the reasons recorded therein.

4. A declaration has been furnished by the proposed Arbitrator, which is at Flag – Z being letter dated 19.12.2019. Counsel for the parties have gone through the declaration and they submit that they also have no objection to the appointment of Mr. Rahul Gupta, learned Advocate of Jharkhand High Court as an Arbitrator to adjudicate the dispute between the parties.

5. Since the proposed Arbitrator has furnished required declaration in terms of Section 12 of the Arbitration and Conciliation Act, 1996, I hereby appoint Mr. Rahul Gupta,

learned Advocate of Jharkhand High Court , at present residing at 97/B, Burdwan Compound, Opp-Holy Cross Convent Burdwan Compound, Ranchi, 834001, Mobile No. 9199543636, 9835322636, as Independent Arbitrator to adjudicate the dispute between the parties. Learned Arbitrator would be free to lay down his fees and other expenses towards conduct of the arbitration proceedings, however keeping into account the ceiling prescribed under Schedule IV of the Act of 1996 as amended. Learned Arbitrator would endeavor to conclude the proceedings expeditiously, also taking into regard the mandate of the Legislature under Section 29-A of the Act of 1996.

6. Let photocopy of the entire pleadings along with copy of the entire order sheet be sent to the learned Arbitrator by the Registry.

7. The present Arbitration Application is disposed of accordingly.
