The petitioner is an accused in connection with Hunterganj P.S. Case No. 115/2019.
A Bank dacoity was committed and huge amount of cash was looted.
Initially the petitioner was implicated on the confession of co-accused Ajay Paswan. It appears that in the Test Identification Parade the petitioner was not identified by the informant as well as the cashier of the Bank. However, the petitioner was identified by one Nagar Deo Yadav and one Prakash Kumar. It appears that T.I. chart has been brought on record in B.A. No. 1081 of 2020 and from a perusal of which it seems that Nagar Deo Yadav had stated about the accused having been shown to him by the Investigating Officer in the Police Station. So far as Prakash Kumar is concerned learned counsel for the petitioner submits that he was a stranger and was not a Bank employee. It further appears that Dilip Singh @ Feku Singh @ Singh @ Sipahiji @ Fauji and Sonu Kumar have been granted bail by this Court in B.A. No. 1081 of 2020 and 1084 of 2020 respectively. The case of the petitioner, therefore, appears to be similarly situated to those who have been granted bail by this Court. The petitioner is in custody since 28.08.2019.
Regard being had to the above, the petitioner, named above, is directed to be released on bail on furnishing bail

bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chatra in connection with Hunterganj P.S. Case No. 115/2019.
