So far as defect no. 4, 9 (v) and 9 (vi) are concerned, learned counsel for the petitioner undertakes to remove the same, once the situation normalises. As regards, rest defects are concerned, the same are ignored.
The petitioner is an accused in connection with Naudiha Bazar P.S. Case No. 64 of 2019 corresponding to S. T. No. 527 of 2019.
The informant who was a married lady came in contact with the petitioner and both were having a love affair. It has been alleged that the petitioner on the assurance of solemnising marriage had established physical relationship with the informant. Later on, when her in-laws had come to know about said affair, she was ousted from the matrimonial house and the petitioner has also refused to solemnize marriage.
The entire gamut of allegations does indicate that the informant in spite of being a married lady had consented to develop a physical relationship with the petitioner which therefore indicates that the informant was a consenting party. The petitioner is in custody since 04.10.2019.
Regard being had to the above, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge V, Palamau in connection with Naudiha Bazar P.S. Case No. 64 of 2019 corresponding to S. T. No. 527 of 2019.
