03/11.08.2020 Heard the parties.
So far as defect no. 5(e) is concerned, learned counsel for the petitioner undertakes to remove the same once the situation normalizes. As regards the rest defects are concerned, same are ignored.
The petitioner is an accused in connection with Govindpur P.S. Case No. 113 of 2019 corresponding to Special POCSO Case No.106 of 2019.
Earlier prayer for bail of the petitioner was rejected by this Court in B.A. No. 9051 of 2019 with a direction to the learned trial court to conclude the trial within a period of six months.
Learned counsel for the petitioner has referred to the evidence of the victim, P.W-1 and has stated that she does not support the prosecution case. However, perusal of the deposition of P.W-1, which has been sent through Email, reveals that she has named the petitioner as the person who had committed rape upon her.
In such view of the matter, therefore, I do find any reason to reconsider the prayer for bail of the petitioner. The same is once again rejected.
