The petitioner apprehends his arrest in connection with Mahila (Sadar) P.S. Case No. 11 of 2016, G.R. No. 3378 of 2016.

The marriage of the informant was solemnized with the petitioner on 1.5.2013. It has been alleged that there was a demand of a motorcycle which was fulfilled. Subsequently, Rs.5,00,000/-was demanded on the promise that it would be returned back. It has further been alleged that the informant was continuously tortured and ultimately ousted from her matrimonial house. The petitioner had earlier filed a suit for restitution of conjugal rights, which was, however, withdrawn.

The petitioner was a constable in JAP –VII and he was dismissed from service on 11.11.2017. The petitioner has also filed a fresh suit for dissolution of marriage with the informant.

Regard being had to the facts, as stated above, I am inclined to extend the privilege of anticipatory bail to the petitioner.

The petitioner, named above, is accordingly directed to surrender in the court below within a period of four weeks from today and pray for regular bail, and in that event, he will be enlarged on bail, on furnishing bail bond of Rs.10,000/- ( Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh in connection with Mahila (Sadar) P.S. Case No. 11 of 2016, G.R. No. 3378 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands allowed.
