Heard learned counsel for the petitioner and learned counsel appearing for the State.

The petitioner is an accused in connection with Nirsa (Kalubathan O.P.) P.S. Case No. 113 of 2019 (G.R. No. 1406 of 2019 & S.T. Case No. 458 of 2019).

It has been alleged that the marriage of the daughter of the informant was solemnized with the petitioner in the year 2015. It has been alleged that there was a demand of dowry and on 03.06.2019 informant received information that her daughter had died on account of a train accident.

Learned A.P.P. while relying on the various paragraphs of the case diary has stated that there was a regular quarrel between the deceased and her in-laws including the husband which resulted in her committing suicide. He has referred to paragraph nos. 9 & 10 of the case diary. On perusal of the said paragraphs it appears that the same contains the statement of the independent witnesses Paresh Nath Mandal and Maharaj Mandal. These witnesses have stated about frequent quarrels between the husband and in-laws of the deceased along with the deceased. The suicide committed by the deceased, therefore, seems to be on account of the domestic quarrels which frequently occurred. Therefore, it cannot be said that it was the petitioner who was mainly responsible for abetting the commission of suicide.

On consideration of the aforesaid facts, the above named petitioner is directed to be released on bail, on furnishing bail bond of Rs. 10,000/(ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-III^rd , Dhanbad in connection with Nirsa (Kalubathan O.P.) P.S. Case No. 113 of 2019 (G.R. No. 1406 of 2019 & S.T. Case No. 458 of 2019).
