The petitioner is apprehending his arrest in connection with Adityapur P.S. Case No. 293 of 2015 (G.R. No. 835 of 2015) registered under Sections 420/406/467/468/471/120 (B) of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, at Seraikella.

Heard the learned counsel for the petitioner and the learned A.P.P. On perusal of paragraph 170 of the case diary, it transpires that letter dated 05.04.2016 was sent by the Allahabad Bank, R.N. College, Hazipur Branch, to the Officer-In-charge, Adityapur Police Station, in connection with Adityapur P.S. Case No. 293 of 2015, stating that signatures of Upendra Singh and Anil Kumar Todi were found to be genuine and accordingly the cheque was honored by the Bank. It transpires that after repeated direction by this Court, the statement of Anil Kumar Todi was recorded by the Officer-In-charge, wherein he has stated that he had not signed on the cheque.

Since the bank officials have found the signature of Anil Todi and Upendra Singh to be genuine, accordingly, I am inclined to extend the privilege of anticipatory bail to the petitioner and he is directed to

surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order and in the event of his arrest or surrender, the court below shall enlarge him on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, at Seraikella in connection with Adityapur P.S. Case No. 293 of 2015 (G.R. No. 835 of 2015) on the conditions as laid down under Section 438 (2) Cr.P.C.
