This revision is directed against the order dated 03.12.2019, passed in Criminal (Juvenile Bail) Appeal No.60 of 2019, whereby the learned Additional Sessions Judge-I-cum-Children's Court, Palamau at Daltonganj, has rejected the prayer for bail of the petitioner (juvenile in conflict with law) in connection with Manatu P.S. Case No.77 of 2005 (corresponding to G.R. No.1956 of 2005) registered under Sections 147,148,149,353, and 307 of the Indian Penal Code, 3 and 4 of Explosive Substance Act, Section 17 C.L.A. Act, Section 25 (I-B) a, 26, 27 and 35 of the Arms Act.

3 . Heard learned counsel for the petitioner and learned A.P.P. On perusal of the impugned order, it appears that the court below has rejected the prayer of the petitioner on the ground that the witnesses have stated that the petitioner at an early age had come in contact with extremists. However, it is evident from the impugned order, as per the social investigation report, the petitioner does not have any criminal antecedent and he wants to reintegrate in the society and lead a normal life.

In the attending facts and circumstances, the petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Juvenile Justice Board, Palamau at Daltonganj, in connection with Manatu P.S. Case No.77 of 2005, corresponding to G.R. No.1956 of 2005, on the condition that one of the bailors shall be the father or close relative,

who shall give an undertaking (i) to ensure the good behaviour of the petitioner, (ii) to ensure that the juvenile petitioner does not come in contact with any anti-social elements, and (iii) produce the juvenile/petitioner before the Probation Officer as and when directed by the Board. The Probation Officer shall submit the supervision report to the Board for needful.

In case of any adverse report, the Board is at liberty to pass necessary order in accordance with the provisions of Juvenile Justice (Care and Protection of Children) Act 2015. The petitioner/juvenile shall co-operate in the enquiry and be present before the Board as and when directed, till conclusion of the enquiry.

4 . With the aforesaid direction, the revision is, hereby, allowed.
