This appeal has been filed under section 14 (A) (2) of the SC/ST (POA) Act being aggrieved and dissatisfied with order dated 24.04.2019 passed by learned Addl. Sessions Judge-1-cum-Spl. Judge, Deoghar in connection with Chitra P.S. Case No. 32 of 2018 and SC/ST Case No. 62/2018 for the offence under sections 323, 341, 386, 380/34 I.P.C and section 25(A) of Arms Act and section 3(x) of SC/ST Act whereby and whereunder prayer for anticipatory bail filed by the appellant has been rejected .

Learned counsel for the appellant has submitted that appellant is innocent and he has been falsely implicated in this case. There is general and vague allegation against the appellant. No case under the alleged offence is made out against the appellant. Further, it has been submitted that the matter has been compromised between the parties.

Today , counsel for the respondent no. 2 has appeared and has submitted that matter has been compromised between the parties.

In the facts and circumstances of the case, this criminal appeal is hereby allowed. Order dated 24.04.2019 passed by the learned Addl. Sessions Judge-1-cum-Spl. Judge, Deoghar is hereby set aside. Accordingly, the above named appellant is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge him on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the court of Addl. Sessions Judge-1-cum-Spl. Judge, Deoghar, in connection with Chitra P.S. Case No. 32 of 2018 and SC/ST Case No. 62/2018 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
