This appeal is directed against the order dated 03.10.2019 passed in Children Case No. 15 of 2019 by the learned Special Judge, Children Court, Giridih by which the prayer for bail made by the appellant has been rejected.

It appears that the appellant and one Deepak Kumar Ram have been alleged to have enticed away Rashmi Kumari and Champa Kumari and had solemnized marriage with them. The victim Champa Kumari on being recovered, recorded her statement under Section 164 CrPC in which she has stated that she had gone to Delhi along the appellant and had solemnized marriage with the appellant and had stayed at Delhi for fifteen days. Another co-accused Deepak Kumar Ram has been granted bail by this Court in B.A. No. 3849 of 2019 and the allegation appears to be similar as that of the appellant since in the statement of the other victim recorded under Section 164 CrPC, it has been stated that she had solemnized marriage with Deepak Kumar Ram.

Considering the similarity of the facts of the case so far as the appellant and Deepak Kumar Ram is concerned, while setting aside the order dated 03.10.2019 passed in Children Case No. 15 of 2019 by the learned Special Judge, Children Court, Giridih, the appellant, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Children’s Court, Giridih in Children Case No. 15 of 2019 subject to the condition that one of the bailors should be the father of the appellant.
