It has been alleged that the daughter of the informant was kidnapped and on being free from the captivity, she returned and disclosed about the accused persons committing rape upon her. Although, the victim seems to have supported the occurrence, so far as the petitioner is concerned, in her statement recorded under Section 161 CrPC as well as in her statement under Section 164 CrPC but in course of trial where she has examined as P.W. – 2 she has not supported the occurrence and thus she has been declared hostile by the prosecution. The petitioner is in custody since 26.06.2019.

Mr. D. K. Karmakar, learned counsel appearing for the informant has vehemently opposed the prayer made by the petitioner.

Regard being had to the fact that the allegation against the petitioner seems to have been diluted in view of the evidence of P.W. – 2, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Chatra, in connection with Sadar P.S. Case No. 202 of 2019 subject to the condition that the petitioner shall remain physically present before the learned trial court on each and every date till the conclusion of the trial .
