The matter is placed before National Lok Adalat.
Both the petitioners and the opposite party no.2 are present before the Lok Adalat today.
It is agreed to between the parties in connection with the claims of the rival parties made in Complaint Case No.1597 of 2016 and Original Maintenance Case No.267 of 2016 of the Family Court, Dhanbad, they have settled all their disputes in full and final settlement on payment of Rs.7,75,000/- to be jointly paid by the petitioners to the opposite party no.2 in the shape of demand draft. Over and above that the father of the opposite party no.2 will go and collect from the house of the petitioners the following articles:-
It is next agreed to between the parties that the opposite party and the petitioner no.1 will appear before the Family Court, Dhanbad on 13th April 2019 and jointly they will file a petition for dissolution of
their marriage by mutual consent and on the date of filing of such petition jointly by the petitioner no.1 and the opposite party no.2 for divorce by way of mutual consent and on that day, the petitioners will hand over a demand draft of Rs.3,75,000/- to the opposite party no.2 and at the time of final hearing of the said petition for dissolution of marriage between the petitioner no.1 and the opposite party no.2 as well as the hearing of the Complaint Case No.1597 of 2016, the petitioners will pay a demand draft of Rs.4,00,000/- in full and final settlement and on the same day, the opposite party no.2 will also withdraw complaint case no. 1597 of 2016.
In case, after handing over the aforesaid articles and payment of Rs.7,75,000/-, the complaint case no.1597 of 2016 cannot be brought to an end then the petitioners will be at liberty to approach the appropriate court for quashing of the complaint and in that proceeding the opposite party no.2 will cooperate.
Accordingly, this criminal miscellaneous petition is disposed of. Let a free copy of this order be supplied to both the parties.
