Apprehending her arrest in connection with Kunda P.S. Case No.33 of 2017 corresponding to G.R. No.507 of 2017 instituted under Sections 406/420 of the Indian Penal Code, the petitioner has moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioner and learned Addl.P.P. appearing for the State.

Learned counsel appearing for the petitioner submits that the petitioner is a lady member of a unit of Ujjivan Small Finance Bank Limited, Deoghar and the allegation against her is that Rs.68,509/- which was entrusted to her to be deposited with the said bank, has not been deposited by her. It is submitted that the said money was snatched away from the petitioner by two miscreants and though she has lodged a report with the police but the police has not registered the same as F.I.R. It is next submitted that the allegations against the petitioner are all false. It is lastly submitted that the petitioner is ready and willing to cooperate with the investigation of the case and to deposit Rs.68,509/- (Rupees sixty eight thousand five hundred nine) with the said Bank. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court of learned Judicial Magistrate, 1^st Class, Deoghar, Distt.- Deoghar within eight weeks from today and in the event of her arrest or surrendering, she will be enlarged on bail on showing proof of deposit of Rs.68,509/- (Rupees sixty eight thousand five hundred nine) with Ujjivan Small Finance Bank Limited, Deoghar

and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Deoghar, Distt.- Deoghar in connection with Kunda P.S. Case No.33 of 2017 corresponding to G.R. No.507 of 2017 with the condition that she will cooperate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish her mobile number and photocopy of the Aadhar Card with an undertaking that she will not change her mobile number during the pendency of the case and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
