This criminal miscellaneous petition has been filed at the instance of the petitioner with a prayer for modification of the order dated 09.10.2017 passed in A.B.A. No.5161 of 2017.
It is submitted by the learned counsel for the petitioner that vide order dated 09.10.2017 passed in A.B.A. No.5161 of 2017, the petitioner was directed to appear/surrender before the court below within four weeks but after filing the anticipatory bail application, the petitioner was transferred to Bangalore and he was suffering from serious ailment and was admitted to Apollo Hospital, Bangalore, hence, the petitioner could not appear/surrender in the court below in terms of the said order within the stipulated time. However, now he is ready to appear/surrender before the court below. Hence it is submitted that the time to surrender before the court below be extended for further four weeks from the date of this order.
Considering the aforesaid submission of the learned counsel for the petitioner, the prayer for extension of time for the petitioner to surrender in the court below in terms of the order dated 09.10.2017 passed in A.B.A. No.5161 of 2017 is allowed. Hence, the petitioner is directed to surrender before the court in terms of the order dated 09.10.2017 passed in A.B.A. No.5161 of 2017 below “within four weeks from the date of this order”.
The order dated 09.10.2017 passed in A.B.A. No.5161 of 2017 is modified to the aforesaid extent only.
Accordingly, this criminal miscellaneous petition is disposed of.
