State.
Petitioner has prayed for anticipatory bail in connection with Giridih(T) P. S. case No. 211 of 2018, for the offence registered under sections 341,323,325,406,506/34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that from perusal of First Information Report, there is allegation of assault is against, Rahul Quarashi and is not against the petitioner, Md. Jafar Quarashi @ Md. Jafar Quaraishi as such, petitioner may be enlarged on bail.
Learned counsel for the State has opposed the prayer bail but has not disputed the fact that there is allegation of assault is against, Rahul Quarashi.
Considering the same, petitioner is directed to be enlarged on anticipatory bail in the event of his surrender/arrest within four weeks from today, on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Giridih(T) P. S. case No. 211 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
However, petitioner shall co-operate in the investigation and shall physically appear before the learned trial court on each and every date till conclusion of trial.
