Heard learned counsel for the petitioner and learned counsel for the State. Petitioner has prayed for grant of anticipatory bail in connection with Tetulmari P.S. Case No.07 of 2018, corresponding to G.R. Case No.743 of 2018, for the offence under Section 414/34 of the Indian Penal Code and under Section 30(ii) of Coal Mines Act.
Learned counsel for the petitioner has submitted that petitioner has no criminal antecedent and petitioner is registered owner of the truck bearing registration No.JH10R-1166. Learned counsel for the petitioner has submitted that he has filed the supplementary affidavit mentioning therein that coal has validly purchased by M/s Singham Coal Private Limited and to that effect he has brought the document on record, as such the petitioner may enlarge on anticipatory bail.
Learned counsel for the State has opposed the prayer for bail but has not disputed that petitioner is the owner of the truck and petitioner has no criminal antecedent.
Considering the rival submissions made by learned counsel for the parties, petitioner named above is directed to be released on anticipatory bail in the event of his surrender/arrest withing four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in connection with Tetulmari P.S. Case No.07 of 2018, corresponding to G.R. Case No.743 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. However, the petitioner shall co-operate in the investigation and physically appear before the trial court on each and every date till framing of charge.
