Petitioners have prayed for anticipatory bail in connection with Gandey P. S. case No. 35 of 2018, corresponding to G. R. No.726 of 2018 for the offence registered under sections 147,148,149,323,324,325,307 and 302 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is case and counter case between the parties and petitioners have been falsely implicated in this case as the father of petitioner no.1 has lodged a Gandey P.S. Case No.36 of 2018 against the informant side, which was registered under Sections 147,148,149,323,324,325 of the Indian Penal Code.

Learned counsel for the State has opposed the prayer bail.

After hearing the learned counsel for the parties, petitioners are directed to be enlarged on anticipatory bail in the event of their surrender/arrest within four weeks from today, on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Giridih, in connection with Gandey P. S. case No. 35 of 2018, corresponding to G. R. No.726 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.

However, petitioners shall co-operate in the investigation and shall physically appear before the learned trial court on each and every date till conclusion of trial.
