The petitioner is an accused in a case registered under Sections 457 and 380 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has committed no offence as alleged. Initially the first information report was lodged against unknown. During investigation, the petitioner has been implicated in the present case on the basis of confessional statement of co-accused- Sachin Ram. Except the said confessional statement, the police has not collected any cogent material to connect the petitioner with the alleged offence. As such, the petitioner who is in judicial custody since 3rd November, 2018 may be given the privilege of regular bail.
Learned APP while opposing the petitioner's prayer for bail submits that the petitioner has criminal antecedent.
Having heard learned counsel for the parties and keeping in view that the petitioner is in judicial custody since 3rd November, 2018, I am inclined to enlarge the petitioner, above named, on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount, each, to the satisfaction of learned Chief Juridical Magistrate, Saraikella, in connection with Adityapur P.S. Case No.64 of 2018, corresponding to G.R. No.251 of 2018(S).
