06/26.08.2019 Learned counsel for the petitioner prays for and is allowed to make necessary correction in paragraph 7 of the present bail application in course of the day.

Heard learned counsel for the parties.

The petitioner is an accused in a case registered for the offence punishable under Sections 379/420/34 IPC.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence as alleged in the F.I.R. Even on perusal of the written report of the informant, it would appear that the ATM card was given by the informant to co-accused Nasim Ansari. There is general and omnibus allegation against the petitioner. Co-accused Md. Nashim Ansari has already been granted bail by a coordinate Bench of this Court vide order dated 13.03.2019 passed in B.A. No. 882/2019. The petitioner is a lady and is in judicial custody since 22.04.2019 and as such she may be given the privilege of regular bail.

Learned A.P.P as well as learned counsel for the informant oppose the petitioner’s prayer for bail.

Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Daltonganj in connection with Hussainabad P.S. Case No. 207/2018, corresponding to G.R. No. 1934/2018.
