The petitioner is an accused in a case registered under Sections 18, 20, 22, 27(A) and 47 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has committed no offence as alleged. It is alleged that the accused persons including the petitioner were indulged in cultivating poppy plants on forest/raiyati land. It would be evident from the self-statement of the informant that the allegation has been levelled on the basis of secret information. It has not been clarified as to on whose information the petitioner has been implicated in the present case. The petitioner has no criminal antecedent, as has been stated in paragraph no.15 of the bail application. As such, the petitioner who is in custody since 27th June, 2019 may be given the privilege of regular bail.
Learned APP opposes the petitioner's prayer for bail.
Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner, above named, on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount, each, to the satisfaction of learned Sessions Judge-cumSpecial Judge, Chatra, in connection with Kunda P.S. Case No.01 of 2017.
