The petitioner is an accused in a case registered for the offence punishable under Sections 392/411 IPC.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence as alleged in the F.I.R. Though the petitioner has been named in the F.I.R, yet his name surfaced on the alleged disclosure made by co-accused Akram Ansari. The petitioner has not been apprehended at the spot. Nothing incriminating has been recovered from the petitioner’s possession. Co-accused Akram Ansari @ Chhotu Ansari has already been granted bail by this Court vide order dated 19.06.2019 passed in B.A. No. 5276/2019. The petitioner is in judicial custody since 09.01.2019 and as such he may be given the privilege of regular bail.
Learned A.P.P opposes the petitioner’s prayer for bail.
Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Sahibganj in connection with Sahibganj GRPS Case No. 21/2018, corresponding to Rail G.R. No. 50/2018.
