02/17.08.2019 Heard learned counsel for the parties.
Petitioner is an accused for the offences punishable under Sections 354A(1)(i)/307/337/338/147/148 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. It is alleged that the petitioner along with two other co-accused persons forcibly tried to get the informant seated on the scooty. It is further alleged that on being objected by the brother of the informant and other persons, they were assaulted. However, nothing has been stated in the F.I.R. regarding the manner of such assault. In fact, the present F.I.R. is completely concocted. The petitioner has been roped in this case due to previous enmity. The petitioner is in judicial custody since 12.06.2019 and as such, he may be given the privilege of regular bail.
Learned A.P.P. opposes the petitioner’s prayer for bail.
Considering the aforesaid facts and circumstances, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.20,000/(rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Chatra in connection with Chatra Sadar P.S. Case no. 133 of 2019.
