The petitioner is an accused in a case registered for the offence punishable under Sections 379/411/414/34 IPC, Section 30(ii) of Coal Mines Act and Section 33 of Forest Act.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence as alleged in the F.I.R. There is alleged recovery of 05 Tons of stolen raw coal from the mini truck being driven by the petitioner. It is further submitted that the petitioner being the driver of the said vehicle was carrying the said coal on the instruction of the owner of the said mini truck. The petitioner is in judicial custody since 25.04.2019 and as such he may be given the privilege of regular bail.
Learned A.P.P opposes the petitioner’s prayer for bail.
Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Ramgarh in connection with Mandu (Kujju) P.S. Case No. 74/2019.
