Mazar Ansari Alias Manzar Ansari Vs the State of Jharkhand

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence as alleged in the F.I.R. The statement of the victim girl has been recorded under Section 164 Cr.P.C in which she has clearly stated that in the night of 09.04.2019, she along with the petitioner had gone to Chhatisgarh and thereafter to Orissa where they stayed for a week in a rented house and thereafter they came back to their village. She has also stated that she had gone out along with the petitioner out of her own will and no force was applied by the petitioner in taking her to different places. Though the victim girl is aged about 17 years, yet considering her statement recorded under Section 164 Cr.P.C, the petitioner who is in judicial custody since 13.05.2019, may be given the privilege of regular bail.

Learned A.P.P opposes the petitioner’s prayer for bail.

Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of the C.J.M, Palamau at Daltonganj in connection with Rehla P.S. Case No. 22/2019.
