12/13.11.2019 Heard Mr. Indrajit Sinha, learned counsel for the petitioner and Mr. A.K.Tiwari, learned counsel for the State assisted by Mr. Md. Zaid, learned counsel appearing for the opposite party no. 2.

Petitioner has been made accused in connection with Jorapokhar (Bhaura) P.S. Case No. 70 of 2018 (S.T. No. 466 of 2018).

It has been alleged that the brother of the informant had gone out from his house but did not return. In the next morning dead body was found hanging in a tree. The petitioner seems to have been implicated on his self-confession. It has been stated that the petitioner and one Sulochana Devi were the conspirators in order to ensure that the deceased get divorce from his wife Lata Devi by falsely implicating Lata Devi in sex scandal. So far as the evidence which has been collected by the investigating officer is concerned para 80 deals with the video clippings and recordings in which discussion was made about preparation of obscene video of Lata Devi and the amount to be paid. The same however does not indicate that it was the petitioner who was involved in the murder of Raj Kishore Mahto. Similarly situated co-accused Sulochana Devi has been granted bail by this Court in B.A. No. 9015 of 2019.

Regard being had to the above, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge, IVth, Dhanbad, in connection with Jorapokhar (Bhaura) P.S. Case No. 70 of 2018 (S.T. No. 466 of 2018).
