State.
The petitioner, who is accused for the offence under Section 7 of the E.C. Act., has prayed for regular bail in connection with Garhwa P.S. Case No. 285 of 2017, corresponding to G.R. Case No. 1508 of 2017.
Learned counsel for the petitioner has submitted that the petitioner is in custody since 26.11.2018. It has been alleged that 3.6 quintal wheat has been recovered from co-accused, as such, petitioner may be enlarged on bail.
Learned counsel for the State has opposed the prayer for bail, but has not disputed the fact that the petitioner is in custody since 26.11.2018.
Considering the rival submissions of the parties, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/-(Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Garhwa in connection with Garhwa P.S. Case No. 285 of 2017, corresponding to G.R. Case No. 1508 of 2017.
