The petitioner, who is an accused for offence under Sections 341/323/325/452/307/379/34 of the Indian Penal Code, prays for anticipatory bail in connection with Adityapur P.S. Case No. 26 of 2018 .
Learned counsel appearing for the petitioner has submitted that there is omnibus allegation against the petitioner and co-accused, Dhiraj Kumar has been enlarged on anticipatory bail in A.B.A. No.4376 of 2018 vide order dated 08.10.2018, as such, the petitioner having no criminal antecedent, may also be enlarged on anticipatory bail.
Learned counsel for the State while opposing prayer for anticipatory bail, has not disputed the factual aspect of the matter.
Considering rival submissions of the parties, the petitioner, above-named, is directed to surrender before the court below within four weeks from today, and on his surrender, he shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Adityapur P.S. Case No. 26 of 2018 corresponding to G.R. No. 124 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
