Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Complaint Case No.1231 of 2018 registered under sections 323/379/498A/504/506/34 of the Indian Penal Code and under section 3/4 of the D.P. Act.

Heard the parties.

Both the petitioner and the opposite party no.2 are present in the Court today.

It is jointly submitted by the petitioner and the complainantopposite party no.2 that they are ready and willing to resume their conjugal life. It is also agreed to between the parties that the petitioner will go to the house of the opposite party no.2 within a week and will take the opposite party no.2 to his house and will keep and maintain the opposite party no.2 with full dignity and honour as his lawful wife.

The Learned counsel for the petitioner submits that the allegations against the petitioner are false and are general and omnibus in nature. It is next submitted that the petitioner undertakes to keep and maintain the opposite party no.2 with full dignity and honour as his lawful wife. It is further submitted that since settlement has been arrived at between the parties, hence it is submitted that the petitioner be given the privilege of anticipatory bail.

Learned Addl. P.P. opposes the prayer for grant of anticipatory bail.

Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the above named petitioner be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of eight weeks from the date of this order, he shall be released on bail on satisfying the court concerned that he has taken the opposite party no.2 to his house and is keeping and maintaining her with full dignity and honour as his lawful wife and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1^st Class, Garhwa, in connection with Complaint Case No.1231 of 2018 with the condition that the petitioner will continue keeping and maintaining the opposite party no.2 as his lawful wife with full dignity and honour and other conditions laid down under section 438 (2) Cr. P.C.
