The petitioner has been made accused for the offence under Sections 147,148,149,323,307,504,302 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the case has been committed to the court of sessions being S.T.No. 350/2018 and the charge has been framed on 04.01.2019 and the petitioner in in custody since 11.10.2018 and there is no specific allegation against this petitioner. Hence, petitioner deserves bail.

Learned APP has opposed the prayer for bail.

I n view of the fact that charge has been framed and the tiral will take some time and also considering the detention of period, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five Thousand) with two sureties of like amount each to the satisfaction of District & Addl. Sessions Judge-III, Chatra, in connection with S.T.No. 350/2018, subject to the condition that one of the bailers must be close relative of the petitioner and subject to the further conditions as follows :

(1) Petitioner is directed to remain physically present before the trial court as and when his presence is required, till conclusion of trial and will cooperate in the trial, failing which the trial court will be at liberty to cancel the bail bonds of the petitioner.

(2) Petitioner is further directed that alongwith the bail bonds, he will furnish his Cell Number and xerox copy of AADHAR Card in the court below.

(3) Further, petitioner shall deposit Rs. 1000/- by way of cost in the account of Army Welfare fund Battle Casualties being A/C No. 90552010165915, IFS Code no. SYNB0009055, Syndicate Bank Branch, South Block, Defence Headquarter, New Delhi, Branch Code:- 9055 and will submit a receipt of the said deposit before the the trial court at the time of furnishing of bail bonds.

Let a copy of this order be communicated to the court below and also handed over to the learned counsel for the parties.
