18/13.11.2019 Heard Mr. Nilesh Kumar, learned counsel for the petitioner and Mrs. Vandana Bharti, learned counsel for the State assisted by Mr. Vikash Kumar, learned counsel appearing for the opposite party no. 2.
Petitioner has been made accused in connection with Adityapur P.S. Case No. 357 of 2017, corresponding to G. R. No. 1237 of 2017.
It has been alleged that the petitioner had taken Rs.13,32,000/- from the informant on the pretext of treatment of his father as well as investment for which a partnership document was also prepared. However the amount was not returned. The petitioner is custody since 04.09.2018.
Regard being had to the period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Adityapur P.S. Case No. 357 of 2017, corresponding to G. R. No. 1237 of 2017, subject to the condition that the petitioner shall deposit a demand draft of Rs. 2,00,000/- before the court belong in the name of opposite party no.2. If the draft is deposited the O.P. No.2 is at liberty to withdraw the same on an application filed before the learned Trial Court. The said deposit shall be without prejudice to the rights of the petitioner.
