Petitioners are apprehending their arrest in connection with Mahuwatand P.S. Case No. 27/2018 for the offence under sections 323/324/325/326/ 341/342/307/427/34 of the Indian Penal Code, pending in the court of Sri S.K. Chandra, learned J.M, Ist Class, Bermo at Tenughat.

Learned counsel for the petitioners petitioner nos. 2, 3 and 4 had earlier moved before this Court in A.B.A. No. 6206/18 which was rejected under order dated 02.01.2019. Further, it has been submitted that the present case is counterblast of Mahuwatand P.S. Case No. 26 of 2018 in which petitioner no. 2 is the informant.

Learned A.P.P opposed the prayer for anticipatory bail.

Considering the facts and circumstances of the case and also the fact that earlier the anticipatory bail application of the petitioner nos. 2 to 4 was rejected and no fresh ground has been made in the instant application, accordingly, prayer for anticipatory bail on behalf of petitioner nos. 2, 3 and 4 are hereby rejected.

So far as prayer for anticipatory bail on behalf of petitioner no. 1-Subo Devi is concerned, I am inclined to grant her anticipatory bail. Accordingly, petitioner no. 1 is directed to surrender in the Court below within four weeks from the date of this order and in the event of her arrest or surrender the Court

below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the court of Sri S.K. Chandra, learned J.M, Ist Class, Bermo at Tenughat in connection with Mahuwatand P.S. Case No. 27/2018 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
