The petitioner has been made accused for the offence under Sections 414/420/467/468/471/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence as alleged in the FIR. Hence, petitioner deserves bail.

Learned APP has opposed the prayer for bail.

From perusal of the impugned order, it appears that one stolen motorcycle bearing no. JH-01C-3978 has been seized from the possession of this petitioner to which he had purchased from the coaccused Amardeo Singh at the cost of Rs. 25,000/-.

Considering the submissions made by the learned counsel for the parties and also considering the period of detention, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five Thousand) with two sureties of like amount each to the satisfaction of CJM, Latehar, in connection with Latehar P.S. Case No. 178/2018, subject to the condition that one of the bailers must be relative of the petitioner and subject to the further conditions as follows :

1. Petitioner is directed to remain physically present before the trial court on each and every date till framing of charge and will cooperate in trial, failing which the trial court will be at liberty to cancel the bail bonds of the petitioner.

2. Petitioner is further directed that alongwith the bail bonds, he will furnish his Cell number and xerox copy of AADHAR Card in the court below.

Let a copy of this order be communicated to the court below through FAX.
