04/13.09.2019 Heard Mr. Manish Kumar, learned counsel for the petitioner and Mr. Rajneesh Vardhan, learned A.P.P. for the State.
The petitioner is an accused in connection with Nagri P.S. Case No. 47 of 2018, corresponding to G.R. No. 1836 of 2018.
It has been alleged that four persons had come at the site on 30.03.2018 and had shot dead the engineer. The informant had suffered fire arm injury on his leg. In course of investigation the evidence of some of the eye-witnesses were recorded. Para seven contains the evidence of Vikash Singh who has stated that the petitioner had earlier collected extortion money from the site manager and on the date of occurrence the petitioner was also present. Similar is the statement given by Yogender Singh which has been mentioned in para 10 of the Case Diary. One of the primary witness namely Loknath Sahu had stated at para 26 of the Case Diary that an unknown person shot at the engineer. He has also however stated that the petitioner was present. The confessional statement of the petitioner has been recorded in para 108 of the Case Diary. Therefore the common thread of all the witnesses is the presence of the petitioner. However, none have stated about the firing made by the petitioner even though the petitioner was known to the said witnesses as he had on an earlier occasion received extortion money from the site manager. The petitioner is in custody since 22.10.2018.

Regard being had to the aforesaid facts, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi in connection with Nagri P.S. Case No. 47 of 2018, corresponding to G.R. No. 1836 of 2018.
