Apart from the defects which are surviving, from the prayer made in the writ petition which has been styled as public interest litigation, it is abundantly clear that it seeks interference of the Court under Article 226 of Constitution of India in the affairs of a private Trust. We are afraid, this matter can’t be gone into public interest when the person aggrieved has adequate remedy under the law to approach the appropriate Court where such issues can be adjudicated on the basis of material pleadings, supporting documents and evidence adduced by the parties. Learned counsel for the petitioner then seeks to withdraw this writ application with a liberty to the person aggrieved to approach the appropriate forum / court of law in respect of the instant grievances. Writ petition is accordingly dismissed as withdrawn with the aforesaid liberty.
