On that day and time, he was going in search of his cow along with her mother. When they had covered about 200 yards from the house and reached near Baliya Ahar then the accused persons, namely, Raju Bhuiyan, Jadwa Bhuiyan, Atma Devi and Gonda Bhuiyan surrounded him and his mother was surrounded by Kaliya Bhuiyan, Belwa Bhuiyan, Ram Charan Bhuiyan and Sarju Bhuiyan. All the accused persons were holding lathi, ballam and farsa in their hands. Raju Bhuiyan and Gonda Bhuiyan gave lathi blows on his head. Then this witness fell down and then other accused persons gave several lathi blows to this witness. This witness has also deposed regarding the land dispute between him and the accused. Belwa Bhuiyan pressed the mouth of the informant by his hand and other accused persons gave lathi blows to the mother of this witness. Due to these blows, the head of the informant was fractured and waist and hands were also injured and fractured. They tried to kill his mother and this witness. He has identified Kaliya Bhuiyan present in the Court. In his cross-examination, he has repeated that he had gone out in search of his cow which was missing and he had come to know that the Bhuiyans had taken the cow and tied it and, therefore, he had gone out to bring his cow back. His mother had cautioned him about going alone. He has further deposed that the accused persons had repeatedly given lathi blows to him, due to which, he had fallen on the ground and thereafter he had become unconscious. He has further deposed that there is a house of the accused persons on the disputed land and that the accused persons had assaulted this witness first and thereafter his mother. Subsequently, he has further deposed that two persons, who were holding lathi, were giving lathi blows on him and Gonda Bhuiyan was hitting this witness from the back of the ballam. Where the blows were given, he cannot remember, he saw that the blood had flowed from the head of his mother. The accused persons were beating the mother of this witness at distance of 10-20 yards, from where this witness has fallen down. He had fallen down where he was assaulted and the mother of this witness has also become unconscious. He cannot precisely says which accused had given which lathi blows; however, he has admitted that there was dispute between his side and the accused side. 7. PW-3 is Dr. Chander Shekhar Agarwal. In his deposition, he has stated that on 10.05.1996 he was posted as a Medical Officer at Primary Health Centre, Itkhori and have examined Uma Devi. He found the following injuries on her person:
