04/08.02.2018: Heard the learned counsel for the petitioner(s). Learned Addl. P.P. opposes the prayer for bail.
The petitioner is an accused for the offence under Section 399, 402 and 34 of the of the Indian Penal Code and Section 25(1-b) (a)/26/35 of the Arms Act.
It is alleged that the petitioner and others were arrested while they were planning to commit dacoity.
Counsel for the petitioner submits that the petitioner is in custody since 2.8.2017 and chargesheet has already been submitted in this case.
In view of the aforesaid fact of this case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Md. Amjad, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Hazaribag, in connection with Chouparan P.S. Case No. 168/2017, corresponding to G.R. No. 2211 of 2017.
