Heard the counsel for the parties.
The petitioner is an accused for the offence punishable under Section(s) 385, 387 and 34 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act and Section 17 of the CLA Act.
It is alleged that the petitioner and one Ravindra Mahto were apprehended and from their possession country made loaded pistol and cartridge were recovered.
Counsel for the petitioner submits that the petitioner is in custody since 17.6.2018 and chargesheet has been submitted in this case. He further submits that similarly situated co-accused, Ravindra Mahto has already been released on bail in B.A. No. 7615 of 2018 vide order dated 28.11.2018.
Learned A.P.P opposes the prayer for bail but has not controverted the aforesaid submission.
In view of the aforesaid fact, I am inclined to release the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Hazaribagh, connection with Barkagaon (Urimari) P.S. Case No. 93/2018, corresponding to G.R. No. 1800/2018, subject to condition that he will appear before the trial court concerned on each and every date of trial, failing which, his bail bond shall stand cancelled and necessary steps shall be taken for his re-arrest.
