Petitioners are accused for allegedly committing the offence punishable under Section 395 of the Indian Penal Code, in connection with Chhattarpur Police Station Case No.128 of 2017 corresponding to G.R. No.1969 of 2017, pending in the Court of learned Chief Judicial Magistrate, Palamau.

It is alleged that the petitioners have committed dacoity in a petrol pump. Petitioners are not named in the FIR. They were not put on Test Identification Parade and nothing has been recovered from their possession. Learned counsel for the petitioners submit that four criminal cases are pending against the petitioners wherein petitioners were taken on remand only on the basis of their confessional statement.

Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioners and submits that some articles were recovered from the petitioner, but the Case Diary, which has been handed over to her does not contain the seizure list.

Considering the submission of the parties, I am inclined to grant bail to the petitioners. Accordingly, petitioners, namely, Robin Singh, Deepak Singh and Yogendra Singh, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Palamau in connection with Chhattarpur Police Station Case No.128 of 2017 corresponding to G.R. No.1969 of 2017, with a condition that the petitioners will appear before the Officer-in-Charge,

Chhattarpur Police Station, Palamau once a month and in the event the petitioner(s) fail to appear before the Officer-in-Charge, Chhattarpur Police Station, Palamau in any particular month, bail bonds furnished by the petitioners shall stand cancelled and the Officer-in-Charge, Chhattarpur Police Station, Palamau will take all steps for re-arrest of the petitioner(s).
