5/04.12.2018 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail.
The petitioner is an accused for allegedly committing offence punishable under Sections 302/34, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act, in connection with S.T. Case No. 128 of 2007(B), arising out of B.S.City P.S. Case No. 226 of 2002 [G.R. No. 989/2002], pending in the Court of District & Additional Sessions Judge1st -cum-Special Judge, Bokaro.
The impugned order suggests that this petitioner was an absconder. The case is of the year 2002 and the petitioner surrenders only on 06.03.2018.
Considering the fact that this petitioner was an absconder, I am not inclined to enlarge him on bail. Accordingly, his prayer for bail is hereby rejected.
