Petitioner has been made accused in connection with Sonari P.S Case No. 98 of 2014, corresponding to G.R No.1579 of 2014, S.T No.149 of 2015, for the offence under Sections 147, 148, 149, 341, 323, 324, 326, 302 of the Indian Penal Code.
The case relates to murder of the brother of the informant who was an eyewitness to the occurrence.
In view of the allegation in the FIR against the petitioner and the other co-accused persons, earlier the bail applications of this petitioner were rejected by this Court, in spite of the fact that the earlier co-accused persons had been granted bail.
Learned counsel for the petitioner has renewed the prayer for bail, submitting that the witnesses examined so far, are not the eyewitnesses to the occurrence, and the informant has already died. The deposition of the witnesses and the FIR has been brought on record to show that the informant had been murdered, for which, a police case was also instituted.
The FIR shows that the petitioner is not an accused in the said
case.
In the facts of this case, I am inclined to release the petitioner, Raju Karmkar, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IX, Jamshedpur East Singhbhum, in connection with Sonari P.S Case No. 98 of 2014, corresponding to G.R No.1579 of 2014, S.T No.149 of 2015.
