Petitioner has been made accused in connection with Chauka P.S Case No. 15 of 2010, corresponding to G.R No.249 of 2010, for the offence under Sections 147, 148, 149, 353, 307, 302 of the Indian Penal Code and Sections 25 (1-B)(a), 26, 27, 35 of the Arms Act, Section17 of the C.L.A Act and Sections 4/5 of Explosive Substance Act.

There was an encounter between the police party and the members of the extremists group, in which, one police constable was killed. The petitioner was named in the FIR to be involved in the encounter. Earlier the bail application of this petitioner was rejected on merits by order dated 9.12.2013 in B.A No. 9232 of 2013.

Learned counsel for the petitioner has renewed the prayer for

bail.

In the facts and circumstances of the case, I am not inclined to enlarge the petitioner, Marshal Tuti @ Marshal Purti, on bail. Accordingly, his prayer for bail is hereby rejected.
