The petitioner is apprehending his arrest connection with C. Case No. 1115 of

2016 for the offence registered under sections 33, 41 & 42 of the Indian Forest Act.

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case. Further, it has been submitted that two tons of mica scrapes have been recovered from the truck bearing NO. DIS-222 and nothing has been recovered from the conscious possession of the petitioner. The petitioner is the owner of Shaktiman truck no. DIS-222.

Learned A.P.P opposed the prayer for anticipatory bail.

Be that as it may, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of the court of learned S.D.J.M, Koderma, in connection with C. Case No. 1115 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The petitioner is directed to deposit Rs. 15,000/before the trial court on the date of his surrender. It is made clear that deposition of aforesaid amount would be subject to result of the case and will not prejudice the case of the petitioner during trial.
